1. About SweetGhar

1.1 SweetGhar.com is a Pakistan-based digital home and real-estate platform designed to help users find, connect and love their home.

The Platform may provide services and features including:

✦ Saved properties, projects and profiles;

✦ Advertising and promotional services; and

✦ Other home-related services and features that we may introduce from time to time.

1.2 SweetGhar is primarily a digital platform and marketplace for discovery, connection and information. Unless expressly stated otherwise, SweetGhar does not itself sell, rent, develop, construct, finance, manage, inspect, guarantee or broker the properties, products or services advertised by third parties.

1.3 The terms "you" and "your" refer to any person accessing or using the Platform, including visitors, registered users, property advertisers, businesses, agents, developers, service providers and other professional users.

2. Acceptance and Changes to These Terms

2.1 By using SweetGhar, you agree to comply with these Terms and all applicable laws and regulations.

2.2 If you do not agree with any part of these Terms, you must stop using the Platform.

2.3 We may update these Terms from time to time to reflect changes to our services, business model, technology, applicable law or other circumstances.

2.4 The updated Terms will be published on this page with an updated "Last Updated" date. Your continued use of SweetGhar after the updated Terms are published constitutes acceptance of the revised Terms, subject to applicable law.

3. SweetGhar's Role

3.1 SweetGhar provides an online platform through which users may discover, advertise, communicate about and connect in relation to properties, housing projects, businesses and home-related services.

3.2 SweetGhar is not itself an estate agency, property owner, developer, landlord, tenant, buyer, seller, mortgage lender, financial adviser, contractor or home-maintenance provider, unless expressly identified as such for a particular service.

3.3 Property and service information is generally supplied by third-party users, advertisers, agents, developers, businesses and professionals.

3.4 Although we may use reasonable measures to improve platform quality and may perform verification or moderation activities, we do not guarantee that every property, user, business, professional, project, price, photograph, description, availability, credential, review or other information provided by third parties is accurate, complete, current or genuine.

3.5 You should independently verify information before making any financial, contractual, property or other decision.

This may include verifying:

✦ Ownership;

✦ Authority to sell or rent;

✦ Title and land records;

✦ Development status;

✦ Prices;

✦ Availability;

✦ Location;

✦ Measurements;

✦ Utilities;

✦ Financing;

✦ Service qualifications;

✦ Identity of the advertiser; and

✦ Any other information relevant to your decision.

4. Property Listings

4.1 Property advertisements may be submitted by owners, agents, brokers, developers, landlords, investors or other authorised advertisers.

4.2 Advertisers are responsible for ensuring that they have the legal right and authority to advertise the property or service they submit.

4.3 Advertisers must ensure that property information is truthful, accurate and not misleading.

4.4 Advertisers must not:

• ✦ Advertise a property they are not authorised to advertise;
• ✦ Knowingly provide false ownership information;
• ✦ Publish misleading prices;
• ✦ Misrepresent property size, location or condition;
• ✦ Publish fraudulent photographs;
• ✦ Advertise unavailable properties as available;
• ✦ Publish misleading prices;
• ✦ Duplicate listings in a misleading manner;
• ✦ Impersonate another person or business; or
• ✦ Use SweetGhar to facilitate unlawful transactions.

4.5 SweetGhar may remove, suspend or modify a listing where we reasonably believe that it violates these Terms, applicable law, our policies or the interests of Platform users.

5.Business and Professional Profiles

SweetGhar may allow businesses and professionals to create profiles, including but not limited to:

✦ Real-estate agents;

✦ Developers;

✦ Investors;

✦ Mortgage/home-finance professionals;

✦ Architects;

✦ Electricians;

✦ Plumbers;

✦ painters;

✦ Decorators;

✦ Contractors;

✦ Material suppliers; and

✦ Other home-related businesses.

5.1 Businesses and professionals are responsible for ensuring that information published on their profiles is accurate and up to date.

5.2 Where a profession or service requires a licence, registration, qualification or other legal authorisation, the relevant business or professional is responsible for maintaining the required authorisation.

5.3 SweetGhar does not guarantee the quality, qualifications, licensing, reliability or performance of any third-party business or professional unless expressly stated.

5.4 Users should independently verify credentials and suitability before engaging a professional or business.

6. Accounts and Registration

6.1 Certain features may require you to create an account.

6.2 You must provide information that is accurate, complete and reasonably current.

6.3 You are responsible for maintaining the confidentiality of your login credentials.

6.4 You must notify SweetGhar if you believe that your account has been accessed without authorisation.

6.5 You must not:

✦ Create accounts for fraudulent purposes;

✦ Impersonate another person;

✦ Use another person's account without permission;

✦ Create multiple accounts to circumvent restrictions;

✦ Provide false identity information; or

✦ Use an account for unlawful activity.

7. User Content

Users may be able to upload:

✦ Photographs;

✦ Property information;

✦ Videos;

✦ Reviews;

✦ Comments;

✦ Posts;

✦ Messages;

✦ Business information;

✦ Documents;

✦ Questions; and

✦ Other material.

7.1 You remain responsible for content that you submit to SweetGhar.

7.2 By submitting content, you confirm that:

• ✦ You have the right to submit it;
• ✦ It is not knowingly false or misleading;
• ✦ It does not unlawfully infringe another person's rights;
• ✦ It does not violate applicable law;
• ✦ It does not contain malicious code; and
• ✦ You have any necessary permissions for photographs, trademarks, personal information and other material included in the content.

7.3 You grant SweetGhar a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, adapt and distribute your submitted content as reasonably necessary to operate, promote and improve the Platform and its services, subject to our Privacy Policy and applicable law.

7.4 SweetGhar may remove or restrict content that we reasonably believe:

✦ Violates these Terms;

✦ Violates applicable law;

✦ Is fraudulent;

✦ Is misleading;

✦ Is abusive or offensive;

✦ Infringes intellectual-property rights;

✦ Creates a safety or security risk; or

✦ Otherwise threatens the integrity of the Platform.

8. Prohibited Conduct

8.1 Commit or facilitate fraud, deception or unlawful activity.

8.2 Upload viruses, malware, malicious code or other harmful material.

8.3 Attempt to gain unauthorised access to our systems, accounts, databases or infrastructure.

8.4 Interfere with the operation or security of the Platform.

8.5 Use bots, scraping systems, automated programs or similar technologies to collect, copy or exploit Platform content without our permission.

8.6 Send spam, bulk unsolicited communications or fraudulent enquiries.

8.7 Use SweetGhar to harass, threaten, abuse or impersonate another person.

8.8 Upload content that is unlawful, defamatory, obscene, sexually explicit, hateful, discriminatory, threatening or otherwise inappropriate.

8.9 Attempt to circumvent our advertising, account, security, payment or access controls.

9. Communication and Enquiries

SweetGhar may allow users to contact advertisers and businesses through forms, messaging, email, phone links or other communication features.

9.1 You should use these communication features for genuine enquiries and legitimate purposes.

9.2 When you contact a third-party advertiser, your information may be shared with that advertiser as necessary to facilitate the enquiry, subject to our Privacy Policy.

9.3 SweetGhar is not responsible for communications, negotiations, agreements or transactions that subsequently occur between users and third parties.

9.4 Any agreement for the purchase, sale, rental, financing, construction, maintenance or provision of services is between the relevant parties unless SweetGhar is expressly identified as a contracting party.

10. Reviews, Ratings and Feedback

10.1 Where SweetGhar allows reviews or ratings, users must provide genuine and honest feedback based on their actual experience.

10.2 Users must not:

✦ Create fake reviews;

✦ Review themselves;

✦ Pay for or incentivise fake reviews;

✦ Manipulate ratings;

✦ Threaten another person to obtain a review; or

✦ Knowingly publish fraudulent or defamatory reviews.

10.3 SweetGhar may moderate, remove or restrict reviews that violate these Terms or applicable law.

11. Home Feed and Personalisation

SweetGhar may personalise portions of the Platform based on information such as your preferences, activity, connections, saved items, searches and interactions.

11.1 Personalisation may affect which properties, projects, businesses, professionals or other content you see.

11.2 Certain paid promotional products, including Trending Ads and Trending Profiles, may receive additional visibility and may be displayed outside or beyond ordinary user preference criteria, as described in the relevant advertising product.

11.3 No placement or promotion guarantees a particular number of views, enquiries, leads, sales, rentals or other results.

12. Paid Services and Advertising

SweetGhar may offer paid services including:

✦ Trending Property Ads;

✦ Trending Community Projects;

✦ Trending Business Profiles;

✦ Home Feed advertising;

✦ Listing-page advertising;

✦ Single-view advertising;

✦ Other promotional products; and

✦ Future paid services.

12.1 Prices, durations, features and availability will be displayed before purchase.

12.2 Paid promotional placement provides the benefits described for the relevant product. It does not guarantee a sale, rental, enquiry, lead, impression, conversion or other commercial result.

12.3 Advertisers must ensure that the content of their advertisements is lawful, accurate and not misleading.

12.4 We may refuse, suspend or remove an advertisement where reasonably necessary because of policy violations, legal requirements, fraud concerns, payment issues, technical issues or other legitimate reasons.

12.5 Refunds and cancellation of paid services are governed by our Refund & Service Policies.

13. Payments

Where SweetGhar offers paid services, payments may be processed through third-party payment providers.

13.1 Payment information may be processed by the relevant payment provider in accordance with its terms and privacy practices.

13.2 SweetGhar does not normally receive or store complete payment-card credentials where payment processing is handled directly by a third-party payment provider.

13.3 You must provide accurate payment and billing information.

13.4 A transaction may be declined, cancelled or placed on hold where required for security, fraud prevention, payment-provider requirements or other legitimate reasons.

14. Intellectual Property

14.1 SweetGhar and its licensors own or control the intellectual-property rights in the Platform, including applicable rights in:

✦ SweetGhar branding;

✦ Logos;

✦ Characters;

✦ Graphics;

✦ Designs;

✦ Text;

✦ Software;

✦ Databases;

✦ Layouts;

✦ Photographs owned or licensed by SweetGhar; and

✦ Other Platform materials.

14.2 You may use the Platform for its intended personal or legitimate business purposes.

14.3 You must not copy, reproduce, modify, distribute, sell, reverse engineer or commercially exploit SweetGhar content or technology without appropriate permission.

14.4 SweetGhar.com and associated SweetGhar branding may not be used in a manner that suggests unauthorised sponsorship, affiliation or endorsement.

15. Third-Party Websites and Services

SweetGhar may contain links or integrations to third-party websites, applications, payment providers, social networks or other services.

SweetGhar does not control those third parties and is not responsible for their:

✦ Availability;

✦ Security;

✦ Privacy practices;

✦ Products;

✦ Services; or

✦ Terms.

Your use of third-party services is subject to the relevant third party's terms and policies.

16. Availability and Technical Issues

We aim to keep SweetGhar available and functioning properly, but we do not guarantee uninterrupted or error-free operation.

We may temporarily suspend or restrict access because of:

✦ Upgrades;

✦ Security issues;

✦ Technical failures;

✦ Internet or hosting problems;

✦ Circumstances beyond our reasonable control; or

✦ Other operational requirements.

17. Information and Disclaimers

17.1 Information on SweetGhar is provided primarily for general information and discovery purposes.

17.2 SweetGhar does not provide legal, financial, investment, mortgage, valuation, construction or other professional advice unless expressly stated.

17.3 Property prices, availability, measurements, descriptions, photographs, project status and other information may change.

17.4 Users should obtain independent professional advice where appropriate, particularly before entering into a property transaction, investment, financing arrangement or significant service contract.

18. User Transactions and Third-Party Services

18.1 SweetGhar does not guarantee the performance of a buyer, seller, landlord, tenant, agent, developer, investor, mortgage professional, architect, contractor, supplier, electrician, plumber, painter, decorator or other third party.

18.2 SweetGhar is not responsible for disputes between users and third parties unless SweetGhar is expressly a party to the relevant transaction.

18.3 Users are responsible for conducting appropriate due diligence before entering into agreements or making payments to third parties.

19. Suspension and Termination

We may suspend, restrict or terminate an account or access to some or all Platform features where we reasonably believe that:

✦ These Terms have been breached;

✦ Applicable law has been violated;

✦ Fraudulent or suspicious activity has occurred;

✦ The account creates a security risk;

✦ The Platform is being misused; or

✦ Action is otherwise reasonably necessary to protect SweetGhar, users or third parties.

Where appropriate and legally permissible, we may provide notice or an opportunity to address the issue.

20. Limitation of Liability

To the maximum extent permitted by applicable law, SweetGhar will not be responsible for indirect, incidental, special or consequential losses arising from your use of, or inability to use, the Platform.

This includes, where legally permitted, losses relating to:

✦ Business interruption;

✦ Loss of profits;

✦ Loss of opportunities;

✦ Loss of anticipated savings;

✦ Loss of goodwill; or

✦ Loss arising from third-party transactions.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable Pakistani law.

21. Indemnity

To the extent permitted by law, you agree to compensate SweetGhar for losses, claims, liabilities, costs and reasonable expenses arising from your:

✦ Unlawful use of the Platform;

✦ Fraudulent activity;

✦ Infringement of another person's rights; or

✦ Content submitted by you that violates these Terms or applicable law.

22. Applicable Law and Jurisdiction

22.1 These Terms and your use of SweetGhar are intended to be governed by the laws applicable in Pakistan, subject to any mandatory rights or protections that may apply to you under applicable law.

22.2 Any dispute arising from these Terms or your use of SweetGhar will be subject to the jurisdiction of the competent courts in Pakistan, subject to applicable law and any mandatory jurisdictional requirements.

25. General

25.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

25.2 Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.

25.3 These Terms, together with the Privacy Policy, Cookie Policy and Refund & Service Policies, form the principal terms governing your use of SweetGhar.

25.4 Different terms may apply to specific paid services, advertising products or other services. Where such additional terms are presented to you, they form part of your agreement with SweetGhar.
